Relief For 14-Seater Matatu owners as Court temporarily stops NTSA from denying them Licenses

The High court on Friday temporarily stopped the National Transport and Safety Authority (NTSA), from denying the 14-seater Matatu operators Licenses until February 15. This comes as government continues with its plan to reduce congestion in major cities and major urban centres.

High Court, Justice Enoch Mwita while issuing the order said that, the NTSA are prohibited from effecting Section 4(2) and 4(3) of legal notice of December 2014, when processing the road service PSV licenses for the petitioners. He also added the notice ordered the licensing of PSVs that carry fewer than 25 passengers stopped from January 1, 2016.

“I promise to issue a comprehensive ruling on February 15, next year since the government has indicated that the first batch of 11 trains and 64 high-capacity commuter buses will arrive in Nairobi around that time, ‘said Justice Mwita.

The directive was issued after 24 Matatu Sacco’s in Nairobi had gone to court to challenge the government’s plan to phase out low-capacity public service vehicle.

Transport Cabinet Secretary James Macharia on December 7, had indicated that the reliance on Matatus was not sustainable and linked it to the congestion in Nairobi County city as well as Mombasa and Kisumu cities.

Kenyans will have just to wait and hope the plan will succeed to minimize city congestion and at the same time address fatal road accidents.
